BRANCARTNEST is an online headwear studio established in 2026 and based in Santa Fe, New Mexico. We design and sell caps and everyday fashion accessories for daily and outdoor wear. Throughout these Terms, the words "we", "us", and "our" refer to BRANCARTNEST, and the words "you" and "your" refer to the person accessing the site or placing an order.

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your state of residence, to place an order with us. By purchasing from BRANCARTNEST you represent that you meet this requirement and that the information you provide during checkout is accurate, current, and complete. If you are using the site on behalf of a business, you represent that you are authorized to bind that business to these Terms.

3. Products and Descriptions

We take care to describe and illustrate our caps as accurately as possible, including materials, dimensions, and colour. Because screens vary and our illustrations are stylized, the exact shade or texture of a finished product may differ slightly from what you see on your device. Small variations in natural materials such as cotton, canvas, corduroy, and linen are a normal part of the product and are not defects.

All products are subject to availability. We reserve the right to change, limit, or discontinue any product at any time, and to correct errors in pricing or description even after an order has been submitted. If a pricing error affects an order you have placed, we will contact you before charging your payment method and give you the option to proceed at the correct price or cancel.

4. Orders and Acceptance

When you place an order you are making an offer to purchase. Your order is accepted only when we confirm it and prepare it for shipment. We may decline or cancel an order for reasons including product unavailability, suspected fraud, an error in price or description, or an inability to verify your payment or delivery details. Where we cancel an order that has already been charged, we will issue a full refund to the original payment method.

5. Pricing and Payment

All prices are shown in United States dollars and, unless stated otherwise, do not include applicable sales tax or shipping charges, which are calculated and displayed at checkout. Payment is processed through the methods offered at checkout, and by submitting payment details you confirm that you are authorized to use the selected payment method. 6. Acceptable Use

You agree to use the BRANCARTNEST site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the site. You may not attempt to gain unauthorized access to any part of the site, introduce malicious code, scrape content at scale, or use the site to transmit unsolicited commercial communications.

7. Intellectual Property

All content on this site, including the BRANCARTNEST name, logo, product names, photography, illustrations, text, and layout, is owned by us or our licensors and is protected by intellectual property laws. 8. Limitation of Liability

To the fullest extent permitted by law, BRANCARTNEST will not be liable for any indirect, incidental, or consequential loss arising out of your use of the site or your purchase of our products. Nothing in these Terms limits any rights you may have under applicable consumer protection law, and our total liability in connection with any order will not exceed the amount you paid for that order.

9. Governing Law

These Terms are governed by the laws of the State of New Mexico and the applicable laws of the United States, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico.
